1. Agreement
These terms govern your use of xmaxx.me and its related applications (the "Service"). The Service is operated by Oskar Freye under the name xmaxx. By creating an account or using the Service, you agree to these terms and the Privacy Policy.
You must be at least 18 years old and able to enter a binding agreement to use the Service.
2. The service
xmaxx provides tools for drafting, scheduling, publishing, measuring, and managing content on X. Features may include notes, analytics, engagement tools, account automations, and optional AI-assisted writing. Some features depend on X, Clerk, payment providers, cloud providers, or other third-party services.
xmaxx is independent from X Corp. X may change its APIs, rules, prices, or availability. Those changes may limit or remove parts of the Service without notice from xmaxx.
3. Your xmaxx account
You must provide accurate information, keep your login secure, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless it results from a security failure controlled by xmaxx.
Authentication is provided through Clerk. Your use of Clerk is also subject to Clerk's terms and privacy practices.
4. Connecting an X account
When you connect an X account, you authorize xmaxx to use the permissions shown on X's consent screen. Depending on the features you enable, those permissions may allow xmaxx to read account information, read posts and metrics, publish or delete posts, and maintain access while you are offline.
xmaxx acts only on accounts you connect and according to actions or automation settings you choose. Review drafts, schedules, and automation rules before enabling them. You remain responsible for content published to your X account and for complying with X's terms and rules.
You can revoke access in xmaxx or through X's connected-app settings. Revoking access may stop scheduled publishing and other account features immediately.
5. Acceptable use
You may not use the Service to:
- send spam, unsolicited bulk messages, or deceptive engagement;
- operate accounts you do not own or have permission to manage;
- evade X rate limits, platform controls, or account restrictions;
- harass people, manipulate platform activity, or coordinate inauthentic behavior;
- publish unlawful, infringing, fraudulent, or malicious content;
- probe, disrupt, reverse engineer, or gain unauthorized access to the Service;
- resell the Service or use it to build a competing service without written permission.
xmaxx may limit or suspend automation that creates compliance, security, or platform risk.
6. Your content and instructions
You retain ownership of content you submit. You grant xmaxx a limited permission to host, process, reproduce, and transmit that content only as needed to operate the Service and carry out your instructions.
You confirm that you have the rights needed to use submitted content. Suggestions, analytics, and AI-assisted output may be incomplete or wrong. You must review output before publishing it.
7. Plans, payment, and cancellation
Paid features, prices, limits, billing intervals, and taxes are shown before purchase. Unless a checkout states otherwise, subscriptions renew automatically until cancelled. You can cancel through any billing controls available in the Service or by contacting oskar@freye.tech.
Cancellation stops future renewal and does not normally refund the current billing period. Mandatory consumer rights and any terms shown during checkout still apply. Payment processing may be handled by Clerk or its payment partners; xmaxx does not store complete payment-card details.
8. Availability and changes
The Service is provided on an as-available basis. xmaxx may change features, limits, or pricing; perform maintenance; or discontinue features. Material changes to a paid plan will be communicated where reasonably possible.
Keep independent copies of important content. The Service is not a permanent archive or a substitute for backups.
9. Suspension and termination
You may stop using the Service at any time. xmaxx may suspend or terminate access for a serious or repeated breach of these terms, legal requirements, non-payment, security threats, or conduct that risks X access for other users.
Terms that must continue by their nature, including ownership, payment obligations, disclaimers, and liability limits, remain effective after termination.
10. Disclaimers and liability
To the extent permitted by law, xmaxx does not guarantee uninterrupted access, a specific level of audience growth, revenue, engagement, or continued access to X APIs. You are responsible for reviewing content and automation before it reaches X.
xmaxx is not liable for indirect, incidental, special, or consequential losses, or for losses caused by X, Clerk, payment providers, internet services, or other third parties outside xmaxx's reasonable control. Nothing in these terms excludes liability that cannot legally be excluded, including liability for intent, gross negligence, or injury to life, body, or health where applicable.
11. Changes and contact
These terms may change as the Service or legal requirements change. The effective date above identifies the current version. Material changes will be communicated through the Service or by email where appropriate.
